Some Indian Ship Recycling Yards Still Can’t Access the EU List, Even After HKC Compliance

Ship Recycling Regulation

HKC-Compliant but Still Locked Out: Why 110+ Indian Recycling Yards Remain Outside the EU List

A shipowner can sell an end-of-life vessel in one phone call, but the cleanest recycling decision is rarely that simple. India now has more than 110 yards with Hong Kong Convention compliance behind them, yet the adopted European List still has no South Asian facility. Two Alang yards may finally break through in the draft 16th update, but that still leaves the larger question on the table: when does HKC compliance become enough for Europe?

Indian HKC yards 110+
Current EU list 41 facilities
South Asia on adopted list Zero
Draft 16th update 2 Indian yards

The issue in two minutes

The Hong Kong Convention is now the global floor. The EU Ship Recycling Regulation is still the European gate. Indian yards can be HKC-compliant, audited and nationally authorised, but EU-flagged ships still need the yard to appear on the European List.

The business friction

  • HKC compliance does not automatically create EU access.
  • EU approval adds third-country application, inspection and political scrutiny.
  • Beaching remains the central environmental dispute.
  • Shipowners still need a defensible recycling file.

Three facts framing the controversy

Fact 1 HKC is in force

The global ship recycling convention entered into force in June 2025 and now sets binding international rules.

Fact 2 India has scale

India says 115 Alang facilities have achieved HKC compliance, with 35 yards seeking EU green-listing.

Fact 3 EU access is separate

The adopted European List has 41 facilities in Europe, Türkiye and the United States, but no South Asian yard.

The commercial read: This is not a simple “green yard versus bad yard” story. It is a standards-recognition fight. BIMCO and shipowner groups argue upgraded Indian yards should be judged facility by facility. Environmental groups argue beaching creates risks the EU should not approve, even when individual yards hold HKC compliance.

HKC compliance versus EU-list access

Issue Hong Kong Convention EU Ship Recycling Regulation Owner impact
Legal role Global IMO convention for safe and environmentally sound recycling. EU regime controlling where EU-flagged large ships can be recycled. Two gates
Yard status Facility must be authorised and operate under an approved plan. Third-country yards must apply to the European Commission and satisfy EU requirements. Extra approval
Ship file Ship-specific IHM, final survey and Ship Recycling Plan matter. EU owners need IHM, Ready for Recycling Certificate and listed-yard destination. Documentation value
Waste chain Requires safe handling and environmentally sound waste management. EU standard puts stronger scrutiny on downstream waste management and facility controls. Audit focus
Controversy Allows recycling states to authorise facilities under HKC standards. Critics argue beaching can conflict with EU expectations for containment and environmental protection. Political risk

Why 110+ yards can still be outside

Barrier What it means Who feels it Practical response
EU-list approval is not automatic HKC compliance can support a case, but the European List is a separate legal process. Indian yards, EU owners, cash buyers. EU application file
Beaching remains the flashpoint Industry argues upgraded yards can meet performance requirements. NGOs argue beaching creates unacceptable containment risk. Commission, yards, insurers, ESG teams. Method scrutiny
Downstream waste proof is decisive Hazardous material handling, storage, disposal and traceability need to stand up to external review. Yards, auditors, waste contractors. Traceability file
Political trust is lagging certification Classification and national authorisation do not erase years of concern about South Asian recycling practices. Yards seeking EU buyers. Inspection transparency
Owner liability does not disappear An owner still needs a defensible end-of-life trail if the sale, flag, cash buyer or destination is challenged. Shipowners, financiers, boards. Transaction controls

The two-yard opening

What may change

The European Commission has proposed adding Shree Ram Vessel Scrap / Shree Ram Shipping Industries and YSI Recyclers to the 16th European List. If adopted, these would become the first Indian yards recognised under the EU Ship Recycling Regulation.

What does not change yet

Two approvals would not solve the wider recognition issue. More than 100 HKC-compliant Indian facilities would still need applications, inspections, evidence files and political confidence before EU-flagged ships can use them.

Where the money goes now

Certification HKC SoC and yard authorisation

Demand trigger: owners and cash buyers need proof the facility meets the global convention.

EU advisory Application and evidence file

Demand trigger: Indian yards want EU-list access and need a defensible Article 13/15 package.

Auditing Independent inspections

Demand trigger: buyers need confidence beyond a certificate or marketing claim.

Waste chain Downstream disposal proof

Demand trigger: hazardous materials, asbestos, oils, coatings and residues need traceable handling.

Owner compliance IHM, SRP and sale controls

Demand trigger: the owner needs a clean recycling trail before board, lender or ESG review.

ESG defense Stakeholder-ready recycling file

Demand trigger: beaching, flag changes and cash-buyer structures can attract scrutiny.

Owner decision screen

Owner situation Best path Risk if ignored Decision posture
EU-flagged vessel Use a facility on the adopted European List unless the list changes before the recycling contract closes. Regulatory breach, sale challenge or reputational exposure. Strict screen
Non-EU flag with EU ownership or lenders Apply EU-style due diligence even if the legal obligation is different. ESG, lender, insurer and customer scrutiny. Enhanced file
Sale through cash buyer Control final destination, recycling plan, IHM, buyer obligations and reporting. The ship can move outside the intended compliance pathway. Contract controls
Indian HKC-compliant yard Build EU-level evidence around safety, beaching controls, impermeable areas and waste traceability. HKC certificate alone may not unlock EU tonnage. Audit-ready
Recycling adviser or broker Compare price against compliance risk, documentation strength and stakeholder tolerance. The highest bid can become the weakest transaction. Value filter

The bottom line: The next recycling premium will not go only to the yard with the highest steel price. It will go to the yard that can prove the safest route through flag rules, EU-list eligibility, HKC documents, IHM quality, waste-chain evidence, worker-safety systems and stakeholder review.
