UK Proposes New Legal Navigation Duties for Masters and Owners as 2027 SOLAS Rewrite Expands Liability

The UK Maritime and Coastguard Agency has opened a four-week consultation on a major rewrite of its merchant-shipping navigation rules that would put several SOLAS Chapter V requirements more directly into domestic law and widen who can be held responsible when they are breached. The proposed Merchant Shipping (Safety of Navigation) Regulations 2027 would replace the 2020 regulations, apply to UK ships wherever they operate and generally to foreign ships while in UK waters, and are intended to enter into force during 2027. Among the most notable changes are a new statutory duty on masters to use the North Atlantic Ice Patrol when required, a new duty on both owners and masters to maintain adequate arrangements for the performance of navigation equipment, expanded company liability, and UK enforcement of the new international rules requiring lost freight containers to be reported. The consultation opened September 2 and closes September 30, 2026.

The proposal is mainly a SOLAS update, but several provisions change who carries direct legal responsibility when navigation procedures, equipment or reporting requirements fail.
