Foreign Tankers Have Been Moving U.S. Cargo — Now Congress Wants to Know Who Was Watching

🔔 Subscribe to ShipUniverse Weekly →

Congressional scrutiny of the emergency Jones Act waiver has shifted from whether foreign tankers should be allowed into U.S. domestic trades to whether the federal government can account for what happened after they entered them. The waiver has operated continuously since March 17, 2026, first for 60 days and then through two 90-day extensions, with the current authority allowing covered cargoes to be loaded through November 15. Federal law requires foreign-vessel operators using the waiver to report each completed voyage to MARAD within 10 days, yet vessel-tracking and ballast-water records identified 14 tanker voyages with strong indications of U.S.-to-U.S. cargo movements that were absent from MARAD's public records, plus a possible fifteenth movement. Rep. Salud Carbajal is now asking DHS whether foreign owners, operators, charterers and crews complied not only with Jones Act reporting requirements, but also with U.S. tax, immigration, customs, safety, environmental and labor rules that the waiver did not suspend.

Emergency Jones Act Waiver · 2026

A 60-Day Emergency Became an Eight-Month Compliance System

The longer the waiver remained active, the more the issue shifted from emergency transportation capacity to tracking, reporting and enforcement across multiple federal agencies.

March 17 → May 17 60 days
Initial limited waiver allowing covered foreign-flag movements between U.S. ports.
May 18 → August 16 +90 days
First extension continued the same basic emergency framework.
August 17 → November 15 +90 days
Second extension added a formal vessel-availability review before new voyages.

The Current Compliance Chain

1. RequestOperator submits vessel, ownership, ports, cargo and national-defense justification.
2. SurveyMARAD checks for available coastwise-qualified U.S. vessels.
3. ClearanceForeign vessel completes CBP entry and domestic cargo documentation.
4. VoyageCovered cargo moves between U.S. points aboard the foreign vessel.
5. ReportOwner/operator and waiver requester must report the completed voyage to MARAD within 10 days.
Statutory Requirement Report within 10 days

The filing must identify the vessel, owner/operator, voyage dates, ports, cargo and national-defense rationale.

What Triggered Scrutiny 14 apparent voyages absent

Independent vessel and ballast-data analysis found strong indications of domestic tanker movements that were not visible in MARAD's public reporting.

Where the Oversight Questions Now Sit

One Waiver, Multiple Federal Rulebooks

Waiving the coastwise shipping restriction did not automatically waive tax, immigration, customs, safety, environmental or labor requirements.
